Absence Management

Absence from work is caused by many reasons and there will be many cases that will need to be dealt with on an individual basis.

Short Term Absence

This can be extremely harmful to any business and must be monitored and managed appropriately, firstly to identify any root cause that could be easily resolved. Persistent short term absence can be a fair reason to dismiss or discipline an employee providing correct processes are followed.

Long Term Absence

This must be handled carefully so that any resulting action is reasonable and fair and requires the following of a process that considers numerous options and alternatives along the way. Employees who have long term health issues are often covered by the Disability Discrimination act which means dismissing an employee and getting it wrong can lead to the employee winning unlimited compensation in an Employment tribunal.

Most people do not associate an employee being late as an absence, but it is, and needs to be treated and managed as such.

Authorised Absences

Absences such as Maternity, Paternity, Adoption and Parental Leave all have their own considerations, not to mention absence such as holidays, compassionate leave and many more.

How can we help?

  • Design, write and implement an Absence Policy and process

Contracts of Employment

All employees, even those employed on a temporary basis require a contract of employment if their employment is anticipated to last in excess of 4 weeks.

Often referred to as a Statement of terms and conditions or contract; as an employer you have a legal duty to provide specific terms in writing within the first 8 weeks of employment. In the absence of written terms an Employment Tribunal will endeavour to ascertain what those terms have been through looking at working practices and day to day routines.

Having terms written down help employees know what is expected of them and defines benefits such as the amount of holiday entitlement and how to report their sickness absence.

How can we help?

  • Provide advice and guidance on the terms that should be included
  • Draft and produce statements of terms and conditions or contracts of employment
  • Assist with advising your employees with what it means to them

Dispute Investigation & Resolution

Things happen in the workplace every day, some which may require investigation before action is taken. Employees can also raise issues that require you to seek further information in order to make appropriate decisions.

Dispute Investigation

There will always be occasions where things do not run as smoothly as you would like. Whether you receive a complaint from an employee who believes they are being bullied, discover stock is missing from your warehouse or have employees who just can't seem to work together, you will have to deal with it. Usually the first step will be to investigate what has happened which can be timely and costly, not to mention distressing and frustrating.

Dispute Resolution

Being in the centre of things means you cannot always see the wood for the trees. Sometimes it helps to get advice from people who have been in similar situations and can look commercially at your decision making and provide sensible solutions.

How can we help?

  • Undertake a full, impartial investigation into any complaint received, including taking statements from those involved and providing a report of the findings with recommendations of next steps
  • Assist with in-house investigations providing advice and guidance on next steps
  • Provide documentation specifically tailored to your needs
  • Train managers in undertaking investigations, collecting evidence and questioning witnesses

Employee Handbooks

These contain all the information an employee needs to know about working for you. They contain information about your business, contact details and employment policies and practices.

Designed to reflect your business and how you want it to work, handbooks act as a guide for all concerned. Not only do they contain up to date legislation on employment matters but also provide advice to employees and answer many questions. Handbooks can sit alongside an existing contract of employment and hold vital information, in hard and/or soft copy format.

How can we help?

Employment Policies

Crucial in any business, without them how do your employees know what is expected of them, how to behave, how to raise issues and the benefits they may be entitled too?

All employers need a minimum of a discipline and grievance policy by law. Many organisations have far more. Whether incorporated into an employee handbook or guide or simply stand alone, there will be numerous times that you need to inform employees of this type of information.

Some are a legal requirement, others provide information on a range of subjects from absence reporting and how it will be dealt with to mobile phone and company car policies. Whatever the need we can produce a policy and documentation to suit.

How can we help?

  • Provide a minimum suite of employment policies for start up or new employers

  • Bespoke documentation for each policy with managers guidelines and aide memoirs
  • Rewrite or update of existing policies with implementation assistance if required

Equality & Diversity

This is an area that is growing day by day and affects all businesses, whether big or small. It's about ensuring that everyone is treated equally regardless of their sex, marital status, race, sexual orientation, religion or belief, disability or age.

There are media reports every day where £1000's are awarded in compensation by tribunals to those who have fallen foul of the law. Did you know that placing an advert for an employee which is deemed discriminatory could see you the wrong side of a claim? You don't even have to be an employee to bring such a claim!

It's also about ensuring that everyone in the workplace, or trying to find work gets equal chances and opportunities. That they are rewarded equally or are not overlooked for promotion, training or a pay rise, for example, due to perceived ideas or prejudice.

How can we help?

  • Provide training to line managers and employees on equality and diversity in the workplace
  • Assess the risk within your workplace by auditing day to day practices such as recruitment, pay awards etc
  • Provide advice and assist with investigating any complaints you receive with potential discrimination issues
